But registration is only mandatory for some high-risk support types, and if the participant’s funding is agency managed, they can only use registered providers. About 40% of total NDIS spending goes to unregistered providers.
While registration is not a guarantee of either safety or quality, it is does make providers accountable and is a way for participants to be able to validate that the provider has taken steps to deliver supports competently. Why can providers be unregistered
When the NDIS was being developed, it was obvious that in order to have a valid registration process, it would need to be detailed and therefore probably onerous to gain, and it would definitely take significant time, money and effort.
But a significant number of disability support providers were small, not-for-profits, set-up by caring and supportive people. They lacked sophisticated systems and did not have resources to create processes. They cared, always put the participant first and would never put a person at risk.
Combined with the principle of participant choice and control, it was decided that registration wouldn’t be mandatory for everyone. There are some limits for high-risk services and agency managed funding, and every provider must be a registered business.
What does it mean to be registered
A registered NDIS provider must meet these conditions…
- Comply with NDIS Practice Standards for the services they provide
- Comply with the NDIS Code of Conduct
- Have systems in place to manage complaints and incidents
- Ensure workers have NDIS Worker Screening clearances
- Notify the NDIS Quality and Safeguards Commissionof significant changes and events
- Pass ongoing NDIS Quality and Safeguards Commission quality audits
- Meet behaviour support requirements
The NDIS is changing
NDIS Review
The NDIS Review final report, published in late 2023, recommended compulsory registration or enrolment for all providers, with what it called a “graduated risk-proportionate model”. A government task force examined this issue and, in August 2024, recommended four types of registration based on risk, including options that protect choice and control.
Worker registration
The taskforce also wanted the disability community and sector to suggest and co-design the definition of “worker”. Then, every worker, regardless of working for a registered or unregistered provider, would need to be registered. This public register would effectively establish a baseline for any person who wants to provide support services for people with disability, and complete transparency for participants when choosing their support workers.
There are strong indications the government will accept and implement these recommendations, but a timeline is yet to be announced.
